DOGGED LLC and Mayuri Billingsley (“Trainer”) and Person/family participating in training (“Client”)
Trainer and Client are collectively referred to as the “Parties.”
Client understands that these lessons take place in a group class setting, and that client and dog will be training in an environment with other un-trained, and potentially aggressive, dogs and clients.
Client acknowledges that training results are variable and depend on many factors out of the Trainer’s control, including but not limited to, dog’s behavior history and past experiences, relationship between dog(s) and Client, amount of time and energy Client dedicates to training dog(s).
Client understands that the recommendation of any other product or service is not a guarantee of satisfaction. Further, Client will remain responsible for the actions of their dog(s) at all times, and hereby agree to indemnify and hold harmless DOGGED LLC including all trainers, manager, of any and all claims of injury, expenses or damages caused by the actions of their dog(s) while under Mayuri Billingsley's instruction, the care of Mayuri Billingsley or under Client’s own care as a result of following the training plan. Client understands the inherent risks of owning a dog(s), including but not limited to, the risk of dog bites to other animals, other people or Client themself. Client acknowledges that the behavior of a moment-to-moment decision-making animal can never be guaranteed. There are no guarantees with dog training and behavior modification, and Client will not hold Mayuri Billingsley or DOGGED LLC responsible if the dog(s) does not meet training goals.
Client warrants that dog(s) is physically fit and in good health, and free of fleas, parasites and infectious diseases. Client must provide proof of vaccines prior to participating in group classes.
Client further acknowledges to follow all group class guidelines – always keeping dog(s) on leash not exceeding six to eight feet in length, no retractable leashes, no slip leads, no prong/choke/pinch/electronic collars (defined as collars that use an electrical mechanism to create auditory, chemical, electrical, haptic noxious stimuli intended to get dog(s) to stop bad behavior). Client warrants that they will not use any such tool or method that will cause the dog(s) physical or psychological hurt while training with Trainer.
Client participation in in-person group classes is solely at the discretion of the Trainer. If the group class environment is not suitable for Client’s dog(s) at the present time, Trainer may ask Client to seek 1:1 training.
Client agrees that the Trainer is not and will not be liable or responsible for any action or inaction, or for any direct or indirect result of any services provided by the Trainer. Client understands training for aggressive/reactive dogs is not guaranteed to change, cure, or treat aggressive and/or reactive behavior.
The Client agrees to assume full legal, financial and moral responsibility for the actions of their dog(s). The Client further expressly waives any liability arising from the generally accepted canine training practices and procedures employed by Trainer. Client, at Client’s expense, shall release, indemnify and hold Trainer and its directors, officers, shareholders, employees and agents, and the personal representatives and assigns of each, harmless from and against and all claims, suits, liability, cost and expenses, including without limitation, reasonable attorneys’ fees and expenses, in connection with any act or omission of Trainer in providing training and/or arising out of any Work Product, unless due to negligence of the Trainer.
Client understands that it is his/her responsibility to be on time for scheduled lessons. Group class lessons are held on a set 50-60 minute scheduled basis, and trainer’s obligation for the scheduled lesson ends at the completion of the scheduled group class hour. No additional "make up" class will be offered if client misses a class.
It is the Client’s responsibility to clean up after themselves and their dog, including all dog’s waste, and dispose of it in the provided waste disposal receptacles.
Client acknowledges that the training area, or any other location deemed appropriate by Trainer, and the animals, guests, items and activities thereon, pose dangers to people and animals. Such dangers include, by way of example and not limitation, animals that can bite, trip, knock down, and fight, indoor and outdoor surfaces that may be slippery, or uneven, equipment that can trip, guests and clients who cannot control their dogs, and activities involving Dog, other dogs that can result in injury from bites or other causes. The Client, on behalf of him/her, his/her spouse/partner and minor children, and anyone else whom Client brings onto Trainer’s Premises, or any other location deemed appropriate by Trainer, assumes the risk of injuries, losses, damages, costs and expenses by any means above described, and other injuries, losses, damages, costs and expenses of every possible cause and description, and agrees to hold harmless and release Trainer, DOGGED LLC, and its owner(s), employee(s), or agent(s)for an
Client assumes the risk, should the Dog be injured in any manner, including fight or altercation with another dog or animal, or accident, gets fleas, ticks or worms, contracts any illness or disease, be lost or stolen, become pregnant, or engage in any dangerous, vicious or unwanted behavior, during or after the term of the Agreement, on or off the Trainer’s Premises, or any other location deemed appropriate by Trainer, and agrees to hold harmless and release Trainer, DOGGED LLC and its owner(s), employee(s), or agent(s)for any resulting injuries, losses, damages, costs or expenses
Cancellation Policy: Trainer reserves the right to cancel group class lessons due to weather, illness, extenuating circumstance or Acts of God. All reasonable effort will be made to reschedule.
Client acknowledges that no refunds will be issued for any reason.
